By accessing or using FreelancerX ("Company," "we," "our," "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Definitions

"Client"

A person or entity seeking freelance services through our platform

"Freelancer"

A person or entity providing services through our platform

"Services"

Web development, design, and other freelance services offered

"Platform"

Our website and associated services

User Accounts

To use certain features of our platform, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use
Be at least 18 years of age to use our services

Services Offered

For Clients

Post projects and job listings
Browse freelancer profiles
Hire freelancers for projects
Make secure payments
Review and rate freelancers

For Freelancers

Create professional profiles
Apply to projects
Showcase portfolio
Receive secure payments
Build client relationships

Payments & Fees

Service Fees

Clients: 5% platform fee on total project value
Freelancers: 10% commission on completed projects
Payment processing fees as per payment gateway
No hidden charges or subscription fees

Payment Terms

Payments are processed through secure gateways
Escrow protection for both parties
Release of funds upon project completion
Refund policy as per project agreement

Project Terms

Milestone Payments

Projects can be divided into milestones with corresponding payments. Both parties must agree on milestones before work begins.

Revisions

Standard packages include 2 rounds of revisions. Additional revisions may incur extra charges.

Intellectual Property

Upon full payment, all intellectual property rights transfer to the client unless otherwise agreed.

Dispute Resolution

In case of disputes between clients and freelancers:

Both parties attempt to resolve directly
Escalate to platform mediation (within 14 days)
Binding arbitration if necessary
Jurisdiction: Chennai, Tamil Nadu, India

We encourage open communication to resolve disputes amicably.

Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users. Upon termination, your right to use the service will cease immediately.

Limitation of Liability

To the fullest extent permitted by law, FreelancerX shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

Governing Law

These Terms shall be governed by the laws of India, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Chennai, Tamil Nadu.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or platform notification. Continued use of the platform constitutes acceptance of modified terms.
